Six to be charged for insulting Perak Sultan via blogs, postings (Update 2)

By LOURDES CHARLES

KUALA LUMPUR : Six people, who allegedly insulted the Sultan of Perak via their blogs or online postings, are expected to be charged on Friday under the Communications and Multimedia Act 1998.

They are expected to be charged in Kuala Lumpur, Petaling Jaya, Kota Kinabalu, and Butterworth under Section 233(1) of the Act for unwise use of network or network services by making comments, demands, suggestions or communication deemed vulgar, false, threatening or disturbing. The charges are to be read together with Section 34 of the Penal Code.

The six will thus become the first to be hauled up under the Act.

Two others are also expected to face similar charges in Terengganu on Sunday.

Those found guilty under the Act face a maximum fine of RM50,000 or a maximum jail term of one year or both as provided for under Section 233(3) of the Act.

Attorney General Tan Sri Abdul Gani Patail confirmed his officers are expected to charge several people on Friday but declined to elaborate on the facts of the case.

It is learnt that several senior Information, Communication and Technology executives working with the Perak State Secretary lodged a report with Malaysian Communications and Multimedia Commission (MCMC) on Feb 16 after reading the offending posting and comments in several of the blogs that is said to be linked to the Sultan of Perak’s web site.

Several of the offending comments were also posted and sent to the Perak state government website.

The MCMC acting on their complaint started a round the clock probe and after about a month of tedious investigations applied and obtained several search warrants from the courts to further investigate the matter.

They (MCMC) officers armed with the search warrants raided several premises and shop lots throughout the country including houses and shops in Taman Tun Dr Ismail in Brickfields, Kajang, Sri Kembangan, Permatang Pauh, Ranau in Sabah and several other places where the culprits were alleged to have operated from.

The sources said the raiding team seized lap tops, modems, personal computers and even telephone bills as evidence that is said to belong to the suspects and would produce them as evidence.

Dalam tulisannya yang bertajuk The Altantuya Shaaribuu’s Case : How and why she was killed? beliau telah mendedahkan bagaimana Azilah Hadri memberitahu Sirul Azhar Umar bahawa mereka akan mendapat bayaran sekitar RM 50,000 – RM 100,000 untuk “menyelesaikan” Altantuya.

Malaysian Deputy Prime Minister, Najib Razak a Lady Killer ?

Altantuya allegations flare up again for Najib

By Leslie Lau

KUALA LUMPUR, March 5 — For Datuk Seri Najib Razak, his alleged links with the Altantuya Shaariibuu murder trial just will not go away.

Today, influential blogger Raja Petra Kamarudin put up on his website a police cautioned statement from Sirul Azhar Umar, who is a co-accused in the murder trial of the Mongolian woman, detailing how he and co-accused Azilah Hadri were expecting to be paid between RM50,000 and RM100,000 to “settle” the matter.

On the same day, French newspaper Liberation also published a story detailing grisly details of how Altantuya was allegedly killed.

According to the “cautioned statement” published by Raja Petra, Sirul claims Azilah told him of a payment of between RM50,000 and RM100,000.

But it is the article in the French newspaper which is particularly damaging to Najib’s image, and which will not be welcome as he prepares to take over the leadership of Umno and become Malaysia’s sixth prime minister at the end of the month.

The article in the Liberation details how Altantuya allegedly begged for her life before she was shot.

According to Liberation , Altantuya was allegedly shot on the left side of her face, and a second time when her assailants noticed her hand was still moving.

The newspaper says it obtained the information from a “cautioned statement” which had been leaked to its writer.

Altantuya was eventually stripped of her clothes, and explosives were placed on different parts of her body. Her assailants then allegedly set off the explosives.

But these were not the parts of the article which were particularly damaging to Najib.

The newspaper claims that Najib had indeed met with Altantuya, who was the mistress of Abdul Razak Baginda, his close aide and associate, in Paris in 2005.

A photograph was allegedly taken showing the three in a Paris nightclub, the Liberation said without providing any evidence.

The Liberation also suggested that Abdul Razak had been Najib’s intermediary for arms purchases.

In October 2006, the newspaper claims that Altantuya was informed that the commission paid by Armaris, a Spanish company involved in Malaysia’s acquisition of three submarines for one billion euros (RM4.7 billion), had been deposited in a bank account in Malaysia.

The commission of 114 million euros was allegedly paid into the account of Perimekar, a company Razak controlled.

Altantuya then allegedly flew to Kuala Lumpur to demand her share of the commission, which was to have been US$500,000.

The Liberation provided no documentary evidence of the sensational details.

But the resurfacing of these links with the Altantuya murder appears designed to embarrass Najib.

Najib has consistently denied any involvement in the murder and has also said he had never met the woman.

But the issue just will not go away, and has been used by rivals to damage his credibility and has proven to be a significant liability for the ruling Barisan Nasional government.

The Shah Alam High Court is set to deliver its verdict on Azilah and Sirul on April 9.

Samy Vellu from Barisan Nasional is a CELAKA Thief

"Let him (Samy Vellu) deny that he hijacked MIED. Let him deny that he hijacked MIC.

"It makes me laugh to hear him (Samy Vellu) calling me a thief. Why isn’t he using the RM2 million collected for the 2004 tsunami victims to help the Sri Lankan Tamils now?

"At that time, he said the victims already had a lot of money and did not need any more. Why isn’t he giving it to the suffering Tamils now?"

MIED spat: Slanging match over missing millions turns vicious

MIC president Datuk Seri S. Samy Vellu and former MIED CEO P. Chitrakala Vasu during ‘happier’ times.

Samy Vellu: She’s a desperate woman.
Chitrakala: Let police find the crook.

KUALA LUMPUR: The claws are out. Both sides have resorted to publicly calling each other a thief.

In what is becoming an increasingly venomous spat, MIC president Datuk Seri S. Samy Vellu accused former Maju Institute of Educational Development chief executive officer P. Chitrakala Vasu of being a "thief devoid of any morals".

His astonishing broadside came in the wake of a press conference held by Chitrakala on Saturday, during which she accused Samy Vellu of misdeeds and charged that "top officials" had dipped their fingers into the MIED kitty.

In a report lodged at the Shah Alam police station, Chitrakala said she was informed that many files were removed from the MIED office on Jan 2 on the instructions of a "top MIC official".

Samy Vellu said yesterday her comments were those of a desperate woman being investigated by police for criminal misappropriation of funds.

"There has never been a greater case of breach of trust by an employee of MIED.

"She is nothing more than a thief devoid of any morals and standards of decency.

"Let me say in no uncertain terms that she and others who are responsible for the misappropriation of MIED funds will be brought to book.

"No amount of threats and personal attacks on me will deter me from that cause."

Chitrakala was equally vocal in her criticism. When contacted, she said: "If that’s what he wants to say, you can publish it. But only a thief will call somebody else a thief."

She voiced disappointment that most of the mainstream media only covered Samy Vellu’s side of the story.

"If Samy Vellu says something, it will be in the news. So, let him say what he wants. I’ll leave it to the police to find out who really is responsible for the money stolen from the Indian community.

"Let him deny that he hijacked MIED. Let him deny that he hijacked MIC.

"It makes me laugh to hear him calling me a thief. Why isn’t he using the RM2 million collected for the 2004 tsunami victims to help the Sri Lankan Tamils now?

"At that time, he said the victims already had a lot of money and did not need any more. Why isn’t he giving it to the suffering Tamils now?"

The spat between Samy Vellu and the 38-year-old mother of four revolves around the institute and cost overruns for its project — the Asian Institute of Medicine, Science and Technology (AIMST) campus in Sungai Petani.

Last December, Tan Sri M. Mahalingam, a signatory of MIED cheques, was removed as MIC treasurer-general in a move described by Samy Vellu as part of an MIC rebranding exercise.

Chitrakala, who joined MIED as an accountant in the late 1990s, resigned in 2002. She was brought back on board in 2004 as its CEO.

MIED, whose core business is providing study loans, sourced millions of ringgit from the Indian community, received about RM300 million from the government and acquired a RM220 million loan from Bank Pembangunan Malaysia to build the AIMST campus.

The cost of construction ballooned from an initial RM230 million to close to RM500 million.

MIC’s probe into the fiasco revealed the disappearance of RM5.25 million.

Duo to be questioned

KUALA LUMPUR: MIC president Datuk Seri S. Samy Vellu and former Maju Institute of Educational Development (MIED) chief executive officer P. Chitrakala Vasu are expected to be interviewed by police next week.

Police have recorded statements from several individuals in connection with a criminal breach of trust case involving the MIED.

Federal Commercial Crimes Investigation Department director Datuk Koh Hong Sun confirmed that they were investigating the case as criminal breach of trust but declined to elaborate.

Duo in hospital after assault by 50 Mat Rempits

By M. KUMAR

KUALA LUMPUR: Two men had to be hospitalised after they were allegedly beaten up by about 50 Mat Rempits who then robbed them in Jalan Pahang, Titiwangsa, near here.

According to one of the victims, Parminder Singh, the incident was supposedly witnessed by a man who looked like a plain-clothes police officer, as he was in possession of a firearm.

“The man not only did nothing to help us but instead urged the assailants to beat us harder,” said Parminder. 21.

The incident happened in the wee hours of last Wednesday when Parminder along with his friend, Sunildip Singh, 25, were travelling in a car towards the city when suddenly a Mat Rempit swerved in front of them and demanded they stepped out of the vehicle.

“When we alighted, we found ourselves suddenly surrounded by about 50 Mat Rempits. Some of them accused us of ramming into the guy who swerved in front of us,” said Parminder.

Without warning, several of the Mat Rempits began beating them with helmets, iron rods and knuckle dusters.

Sunildip, who had his jaw fractured in three places, said there was no way to defend themselves as more Mat Rempits joined in the assault, adding that he fainted soon after.

The mob then took his wallet and cellphone.

Sentul OCPD Asst Comm Zakaria Pagan confirmed the incident but said the victim did not mention anything about seeing a plain-clothes policeman at the scene of the assault.

“Investigations are under way. We estimated the number of Mat Rempits to be around 20 based on the victim’s report.”

ACP Zakaria said the police would contact the victim to obtain more details on the alleged policeman.

Khairy: Umno Youth must refrain from confrontation

KUALA LUMPUR : Umno Youth vice-head Khairy Jamaludin advised its 700,000 members on Sunday against resorting to confrontation or physical violence that could lead to chaos.

He said the movement had never encouraged or condoned such acts by its members.

"But a the same time, I wish to stress that all this cropped because of Karpal Singh’s abrasive remarks in the Dewan Rakyat.

"I feel Karpal Singh should be careful, don’t provoke the sentiments of Umno Youth grassroots because I think their anger is serious and he should watch his words," he told reporters after officiating the Seputeh Youth Open Futsal Championship, here.

Khairy, who is also the Member of Parliament (MP) for Rembau, said this when asked to comment on the commotion that occurred at Parliament House on Thursday, involving 30 members of the Selangor Umno Youth and Karpal, who is the Bukit Gelugor MP and DAP chairman. – Bernama

Bar Council tells MACC to stop the harassment

BAR Council, let me tell you something.  The reason why MACC is harrassing is because BN is squeezing the balls of Malaysian Anti-Corruption Commission’s Chief Commissioner (Datuk Seri Ahmad Said Hamdan).

You see Datuk Seri Ahmad’s fucking pilot son was caught with child pornography.  You know, 13 year old boy sucking an adult dick or a 13 year old girl being fucked by a big cock, underaged sex, etc. (CHILD PORNOGRAPHY)!!  I mean which fucked up mind would want to watch child pornography?  Well, Datuk Seri Ahmad’s fucked up son watched it and was going to distribute it in Australia.  But fortunately this fucker was caught.  This fucking pilot flies for MAS.  WTF ?  National Airline somemore.  His staff number is 1086993.

As you can see, when somebody holds your balls e.g.

BN to Ahmad Said: Oi fucker, if you don’t follow to my wishes i.e. to pretend to expose Khalid, I will expose your son.  Your son will go to jail for child pornography.

Ahmad Said to BN: ok ok.  please don’t send him to jail.  I will make a fictitious statement in press tomorrow.

end of story

By the Bar Council in The Nut Graph

PETALING JAYA, 26 Feb 2009: The Bar Council has come out to question the recent conduct of the Malaysian Anti-Corruption Commission (MACC), particularly in the way it handled cases related to the Perak political crisis and Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim.

In the statement issued today, Malaysian Bar president Datuk Ambiga Sreenevasan said the harassment should stop.

The following is the full statement:

"There are countries around the world where the rule of law means little. In these countries, institutions that are meant to serve the interests of the public are instead tools of the government. Those that have views opposing those in power are harassed and harangued in order to wear them out or silence them. The democratic systems in these countries are constantly under attack or subjected to manipulations by those in power. The governments in these nations betray their citizens who value democracy and the rule of law.

In Malaysia we have pledged to uphold the Constitution and to respect the rule of law. We must all abide by this.

When launching the MACC two days ago, the prime minister gave the sobering advice that the MACC must not end up with the same perceptions that afflicted the ACA (Anti-corruption Agency) — of not being independent, of being a toothless tiger, of practising selective enforcement and of not being professional in their investigations, all of which damaged the ACA’s reputation and credibility.

Yet a few days before that, the MACC director, in an unusual move, had made a public statement about investigations against the menteri besar (MB) of Selangor in a way that raises serious questions about the impartiality of the commission.  Then, yesterday, the MACC reportedly interrogated the speaker of the Perak legislative assembly for three hours. The day before that, the police had interrogated him for a few hours.

These events give rise to two concerns.  One is of the harassment of the speaker and an interference with his duties, and the other is that there is an unusual haste and publicity in relation to the MB’s case when far more serious reports against others appear to have been put aside.

How then is the MACC seeking to remove the negative perceptions the prime minister spoke of?  These events also cause to question what regard the authorities really have for the interests of the public and the public perception.

The public are ever watchful of what is unfolding before them. They know what is happening. They do not wish to see our institutions undermined. They want our institutions to be impartial, independent, courageous and respected. They know that the rule of law is vital and that democratic institutions must be strong. The public must never be underestimated in their appreciation of these issues.

Syabas boss says his RM5.1 million pay is justified

RM 5.1million ?  What the fuck.  why don’t you go down to Syabas and see how the clerks with-hold development plans.  No wonder SYABAS is corrupted.

By Neville Spykerman (The Malaysian Insider)

SHAH ALAM, Feb 26 — Tan Sri Rozali Ismail, the chairman of Syarikat Bekalan Air Selangor (Syabas) and Puncak Niaga Sdn Bhd said today the RM5.1 million salary paid to him in 2007 for running the companies were justified.

“If you want professionals to run your company, you have to pay professional fees.”

Rozali, was speaking in response to the disclosures from the State Water Review Panel.

During a media briefing earlier, today, the panel also revealed that Syabas was financially stressed due to poor management practices, among them paying Puncak Niaga RM700,000 in management fee every month.

Klang Member of Parliament Charles Santiago, who is a member of the panel, said Syabas had been paying the fees, since 2004.

However Rozali denied any knowledge of it.

The Selangor State and Federal Government are currently in dispute over the restructuring and consolidating the water services industries in the state.

The state has offered to end the concessions and to repurchase the assets of Puncak Niaga, Syarikat Pengeluaran Air Selangor Holdings (SPLASH) and Konsortium Abbas Sdn Bhd, which treat raw water and Syabas, which distributes it to consumers.

The concessionaires have rejected the state’s offer of RM5.7 billion after the Federal Government announced they were entering into direct negotiations with the four companies.

Rozali today sidestepped questions on how much the concessionaries were seeking.

He said the actual amount would depend on Puncak Niaga and Syabas’ “golden shareholders”, which is the Ministry of Finance and their bond holders.

“We will have to get the endorsement of all parties before we can decide on the amount.”

He added that under the Water Services Industry Act 2006 , the concessionaires had a choice of maintaining the existing concession agreements or migrating to a new deal which is still being negotiated with the Federal Government.

However members of the Selangor Water Review Panel claimed today the federal government plan of buying the assets of the company while allowing them to continue treating and distribute the water as a bailout.

The panel disclosed the concessionaries collectively had debts amounting to RM6.4 billion.

Santiago said under the federal plan, the concessionaires huge debts would be taken care of while they continued making profits. “The federal plan defeats the purposed of the restructuring exercise.”

He said the concessionaires will just be called licensees under the deal and will still be able to raise water tariffs at the rate of between 10 and 12 per cent, every three years.
